In these terms, we, us and our mean YB Life Pty Ltd (ABN 94 667 901 537, ACN 667 901 537) trading as Faybl, of Level 29, Chifley Tower, 2 Chifley Square, Sydney NSW 2000. You and your mean you, the person visiting the website.
1.1 These terms apply to the website at faybl.com, including its pages, content, downloads and forms (the Website).
1.2 They do not apply to the Faybl service itself, which is governed by separate terms.
1.3 If you do not agree to these terms, do not use the Website.
2.1 The Website gives general information about Faybl and our business. It is not financial product advice, legal advice or any other professional advice, and it does not take into account anyone's objectives, financial situation or needs.
2.2 Faybl does not hold an Australian financial services licence and does not give financial product advice.
2.3 We aim to keep the Website accurate and current, but we do not promise that it is complete, up to date or free of errors.
2.4 Descriptions, examples, screenshots and demonstrations on the Website illustrate how Faybl can be used. The features available to a subscriber depend on its subscription, its configuration and the systems it connects.
2.5 Any pricing on the Website is a guide only and is not an offer. The fees for a subscription are those set out in the subscription agreement.
3.1 You may view, download and print pages from the Website for your own information, or to evaluate Faybl for your business.

5.2 The Faybl name and logo belong to us. You may use them only as we permit in writing.
5.3 If you give us feedback or suggestions, we may use them without owing you anything.
6.1 The Website may link to other websites, or show content from other parties. We are not responsible for them, and a link is not an endorsement.
6.2 Names of other products, such as Xplan, belong to their owners. We use them only to describe the systems Faybl works with, and their use does not mean the owner endorses Faybl.
6.3 You may link to the Website's home page in a way that is fair and lawful and does not suggest an association with, or endorsement by, us that does not exist.
7.1 We may change, suspend or remove the Website or any part of it at any time.
7.2 The Website may be unavailable from time to time, including for maintenance.
8.1 Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under any other law, where doing so would be against the law (a Non-Excludable Right).
8.2 Where we are allowed to limit our liability for a breach of a Non-Excludable Right, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
8.3 This clause prevails over any other clause in these terms.
9.1 This clause is subject to clause 8.
9.2 We provide the Website free of charge. To the extent the law allows, we are not liable for any loss arising from your use of, or reliance on, the Website or its content, or from the Website being unavailable.
9.3 We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited at law.
10.1 We may change these terms by publishing an updated version on the Website. The version published when you use the Website applies to that use.
10.2 The current version is always available at faybl.com/website-terms.
11.1 If part of these terms is invalid, that part is severed and the rest continues.
11.2 If we do not enforce a right straight away, we do not give it up.
11.3 If you visit the Website from outside Australia, you are responsible for complying with the laws that apply where you are.
11.4 These terms are governed by the law of New South Wales, and each of us submits to the exclusive jurisdiction of the courts of New South Wales.
